1. Acceptance of Terms

By accessing or using any services provided by Senaix Private Limited ("Senaix," "we," "us," or "our"), including the Senaix website, Srvish platform, and all related services, you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use our services.

2. Description of Services

Senaix provides digital infrastructure and software engineering services, including but not limited to:

• Custom SaaS product engineering
• Enterprise systems integration
• Digital strategy and technology consulting
• AI and machine learning solutions
• Performance monitoring and infrastructure management
• Srvish — a unified business command center (launching June 21, 2026)

3. User Accounts

When creating an account or submitting information through our platform:

• You must provide accurate and complete information
• You are responsible for maintaining the security of your account credentials
• You must be at least 18 years old or the age of majority in your jurisdiction
• You are responsible for all activities under your account
• You must notify us immediately of any unauthorized access

4. Intellectual Property

All content, features, and functionality of our services—including text, graphics, logos, software, and code—are owned by Senaix Private Limited and are protected by intellectual property laws.

• You may not copy, modify, distribute, or reverse-engineer any part of our services
• The Senaix and Srvish names, logos, and trademarks may not be used without prior written consent
• Custom work delivered under service agreements is governed by the specific contract terms

5. Acceptable Use

You agree not to use our services to:

• Violate any applicable laws or regulations
• Transmit harmful, fraudulent, or misleading content
• Attempt to gain unauthorized access to our systems or networks
• Interfere with the proper functioning of our services
• Engage in automated data collection without consent
• Use our services to compete directly with Senaix without written agreement

6. Early Access Program

Participation in our Early Access program is subject to availability. Early access features may be incomplete, contain bugs, or change without notice. By joining the Early Access program, you acknowledge that the product is pre-release and agree to provide feedback that may be used to improve the service.

7. Payment and Billing

• Pricing for services is as agreed upon in individual service contracts
• Payments are due according to the terms specified in your agreement
• All fees are exclusive of applicable taxes unless stated otherwise
• Late payments may incur interest charges as specified in your contract
• We reserve the right to suspend services for overdue payments

8. Service Level and Availability

While we strive for high availability, we do not guarantee uninterrupted service. Scheduled maintenance and updates may temporarily affect availability. Specific service level agreements (SLAs) are defined in individual client contracts.

9. Limitation of Liability

To the maximum extent permitted by law, Senaix shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services. Our total liability shall not exceed the amount paid by you for the services in the twelve months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless Senaix, its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of our services, violation of these terms, or infringement of any third-party rights.

11. Termination

Either party may terminate the use of services as per the terms of the applicable agreement. We reserve the right to suspend or terminate access to our services immediately if you violate these Terms of Service. Upon termination, your right to use the services ceases immediately.

12. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of India. Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the courts in Bangalore, Karnataka, India.

13. Changes to Terms

We reserve the right to modify these Terms of Service at any time. Material changes will be communicated through our website or via email. Continued use of our services after changes constitutes acceptance of the revised terms.
